SECTION 10 – SHIPPING (US-ONLY), SPLIT SHIPMENTS & RISK OF LOSS
  • US scope: We currently ship within the United States only. Specific processing and delivery estimates are stated on our Shipping Policy page.
  • Tracking & split shipments: Orders may ship in multiple packages for speed and availability. Each package will have its own tracking number and may arrive on different days within the stated delivery window.
  • Address accuracy: Please provide a complete and accurate shipping address. Undeliverable or refused packages may be reshipped (additional charges may apply) or refunded per our policies.
  • Risk of loss: Title and risk of loss pass to you upon our delivery to the carrier, subject to applicable consumer law.
SECTION 11 – TAXES, FEES & PROMOTIONS
  • Applicable US sales taxes are calculated at checkout and may be collected by us or by a marketplace facilitator where required by law.
  • Promotions are subject to their own terms and may not be combined unless stated.

Occasionally there may be typographical errors or omissions in product descriptions, pricing, promotions, shipping charges, transit times, and availability. Our aggregate liability will not exceed the amount you paid for the product or USD $100, whichever is greater. Nothing in these Terms limits non-waivable consumer rights under applicable law.

You agree to indemnify, defend, and hold harmless Pawfect Cause and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any third-party claims and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law, or your infringement of third-party rights.

We are not liable for any delay or failure due to events beyond our reasonable control, including natural disasters, acts of government, labor disputes, power or Internet failures, carrier disruptions, or other force majeure events.

SECTION 20 – DISPUTE RESOLUTION (US CUSTOMERS)

Binding Arbitration & Class Action Waiver. For customers located in the United States, any dispute arising out of or relating to the Services or these Terms will be resolved individually by binding arbitration under the Federal Arbitration Act and the rules of the American Arbitration Association (AAA) or JAMS, rather than in court. No jury trial. No class or representative actions. You may opt out within 30 days of your first purchase by emailing support@pawfect-cause.com with subject “Arbitration Opt-Out” and your order number. If this clause is found unenforceable as to a particular claim, such claim may proceed in court as provided below.

SECTION 21 – GOVERNING LAW & VENUE (US-ONLY)

These Terms and any disputes are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Subject to the arbitration clause above, the exclusive venue for any permitted court action is in the state or federal courts located in Delaware, and you consent to their jurisdiction.

SECTION 22 – SEVERABILITY

If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed without affecting the validity of the remaining provisions.

These Terms are effective unless and until terminated by either you or us. You may terminate by ceasing use of the Services. We may terminate immediately if we believe you have violated these Terms. Obligations and liabilities incurred before termination survive termination.

These Terms and any policies posted on our site (including our Privacy Policy, Shipping Policy, and Return & Refund Policy) constitute the entire agreement between you and us and supersede any prior agreements or communications.
